The ADA statute itself (42 U.S.C. §12187) states that Title III's provisions do not apply to religious organizations or entities controlled by religious organizations, including places of worship. The U.S. Department of Justice's Title III Technical Assistance Manual describes this exemption as very broad: it covers all of a religious entity's activities, whether religious or secular, and the entity does not lose the exemption simply because a service is open to the general public. In practical terms, the assistive-listening requirements the ADA places on a theater or courtroom generally do not legally bind a congregation for the activities it operates itself.

Many worship communities nonetheless choose to provide assistive listening as a matter of hospitality and inclusion - and there are situations where the picture changes.
